The following terms and conditions (the “Terms”) govern your access to and use of the Sorted Out website (the “Site”), any services provided through the Site, and all related materials.
General
By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site.
These Terms may be updated from time to time. The version published on the Site at the time of your use applies. Continued use of the Site following any changes constitutes acceptance of the updated Terms.
For the purposes of these Terms, “Sorted Out”, “we”, “us”, and “our” refer to the operators of the Sorted Out platform based in Australia.
Nature of Services
Sorted Out is not a law firm and does not provide legal advice. The Site provides general legal information, educational resources, and document-generation tools only. Nothing on the Site is intended to constitute legal advice or a substitute for advice from a qualified Australian legal practitioner.
Use of the Site does not create a solicitor-client relationship between you and Sorted Out or any person associated with Sorted Out.
You acknowledge that laws vary between jurisdictions and that the information and documents provided may not be appropriate for your specific circumstances. You are solely responsible for determining whether any information or document is suitable for your use and for obtaining independent legal advice where required.
Sorted Out Material and Services
“Sorted Out Material” includes all content made available through the Site, including documents, templates, text, software, tools, graphics, and other materials. “Sorted Out Services” refers to any services offered through the Site, whether free or paid.
You must not resell, distribute, publish, licence, or make available any Sorted Out Material to third parties, except as expressly permitted by these Terms.
Payment, Subscriptions, and Free Trials
Prices are displayed in Australian dollars (AUD) and include GST unless otherwise stated.
If you enter a free trial, you are responsible for cancelling before the end of the trial period if you do not wish to continue to a paid subscription. Failure to cancel will result in automatic conversion to a paid subscription at the rate disclosed at the time of sign-up.
Subscription fees are charged in advance and renew automatically unless cancelled in accordance with the cancellation process outlined on the Site.
We reserve the right to change pricing, subscription structures, or offerings at any time, subject to compliance with Australian Consumer Law.
No Legal Advice and User Responsibility
You acknowledge and agree that Sorted Out does not provide legal advice.
You accept full responsibility for all decisions made using the Site, including the selection, completion, and use of any document. You are responsible for ensuring compliance with applicable laws and for seeking advice from a qualified lawyer where appropriate.
Any communication from Sorted Out that could reasonably be interpreted as legal advice is unauthorised and should not be relied upon.
Restrictions on Use
You must not use the Site or Sorted Out Material for any unlawful purpose, in a manner that infringes intellectual property rights, or in a way that interferes with the operation of the Site.
You must not attempt to reverse engineer, copy, scrape, automate, or reproduce the Site or its content, nor use Sorted Out Material to create competing products or services.
We reserve the right to suspend or terminate access to the Site at our discretion, including where these Terms are breached.
Intellectual Property
All intellectual property rights in the Site and Sorted Out Material, whether registered or unregistered, remain the property of Sorted Out or its licensors.
Nothing in these Terms grants you ownership of any intellectual property. Your rights are limited to the licence expressly granted under these Terms.
Unauthorised use of Sorted Out Material may result in legal action.
Warranties and Disclaimers
To the maximum extent permitted by law, the Site, Sorted Out Material, and Sorted Out Services are provided on an “as is” and “as available” basis without warranties of any kind.
We do not warrant that the Site will be uninterrupted, error-free, secure, or compatible with all devices or browsers.
We do not verify user identities or authenticate electronic signatures. You are responsible for determining whether electronic execution of documents is appropriate for your circumstances.
Limitation of Liability
To the maximum extent permitted by Australian Consumer Law, Sorted Out is not liable for any loss, damage, cost, or expense arising from your use of the Site, reliance on Sorted Out Material, or inability to access the Site.
Where liability cannot be excluded, our liability is limited, at our option, to resupplying the relevant service or refunding the amount paid for that service.
Any maximum liability for guarantees or quality assurances expressly offered on the Site is limited to AUD $25,000 unless otherwise stated.
Refunds and Guarantees
Refunds and guarantees are only available where expressly stated and are subject to any conditions disclosed at the time of purchase.
Free trials are not refundable once converted to paid access.
Nothing in these Terms limits your rights under the Australian Consumer Law.
Privacy
Your personal information is collected, used, and stored in accordance with our Privacy Policy.
Indemnity
You agree to indemnify and hold harmless Sorted Out and its officers, contractors, and employees from any claims, losses, damages, or expenses arising from your breach of these Terms or misuse of the Site.
Governing Law and Jurisdiction
These Terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of Australia.
Dispute Resolution
In the event of a dispute, the parties agree to attempt to resolve the matter through good faith negotiations before commencing legal proceedings, except where urgent relief is required.
Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
Waiver
Failure to enforce any provision of these Terms does not constitute a waiver of that provision.
Entire Agreement
These Terms, together with the Disclaimer, Privacy Policy, and any pricing or product-specific terms displayed on the Site, constitute the entire agreement between you and Sorted Out regarding use of the Site.
